In every divorce parents often forget what should matter most in their life, their children. Many estranged parents are so emotionally frustrated and thinking only of revenge or of protecting their assets, that they quickly forget that it is wrong to use children to achieve these goals. People would be well advised to do everything to separate concerns about property and children.

Many studies have shown that children of divorcing families, are far more likely to suffer depression, become dependant on drugs or have major emotional or school problems if their paerents are hostile and vengeful to one another.

Child custody cases tend to be the most emotional and when parents are in dispute about what is in their child's best interest, the courts intervene. You want to make sure that your child is protected. Robert Aronov & Associates, P.C. will help you fight for your and your child's best interest.

Child custody refers to the legal guardianship in a divorce case. There are two forms of custody, legal and physical. Legal refers to the child's lifestyle such as religious, medical, and educational decisions. Legal custody can be granted to either one or both parents. On the other hand physical custody refers to where the child lives. Parents may have sole physical custody, and the other may have visitation rights or, both parents may have physical custody, which means the child lives with each parent half of the time. For visitation rights, the visits between parent and child are scheduled according to a schedule provided by the court at mutually convenient for both parents times.

Prior to implementation of the Child Support Standards Act ("CSSA"), the amount of child support awarded the custodial parent was subjective. Child Support Standards Act limited that by establishing statutory guidelines which set the amounts of child support on the first $80,000 of combined parental income, with limited exceptions, based on a percentage of that income depending on the number of children, One child = 17%; Two children =25%; Three children =29%; Four children =31%; Five or more children =not less than 35%.

When calculating the parental income, the Courts consider not only money actually earned or received but also that which is available to the parents, fringe benefits received as well as moneys received from relatives and friends.

In the event combined parental income exceeds $80,000/year, the courts are given the option to apply the above percentages to the total income or consider such factors as the financial resources of the parents and child, the physical, emotional and special needs of the child, the standard of living that would have existed had the household not been dissolved, the non-monetary contributions of the parents, the disparity of income between the parents, and the needs of other children of the non-custodial parent. Child Support Standards Act permits awards for private school, child care expenses to enable the custodial parent to seek or maintain employment or attend school and health care needs.
